Strict Regulation for Medical Use


In a significant policy shift, Thailand’s new government has proposed a bill to amend the existing cannabis legislation, aiming to strictly regulate the use of cannabis for medical purposes and prohibit its recreational use. The move comes in response to the rapid expansion of cannabis shops across the country following the decriminalization of recreational cannabis, a phenomenon that has occurred without sufficient oversight.

The New Cannabis Legislation

The Public Health Minister of Thailand has signed the proposed legislation, underscoring that cannabis must be used solely for medical purposes. The new law is designed to encourage the health benefits of cannabis and has measures in place to control and prevent its recreational use. To become effective, the bill will need approval from the cabinet and submission to the Lower House for consideration.

Once passed, the law will regulate the sale of cannabis products and assist law enforcement agencies in capturing those who misuse cannabis for recreational purposes. Cannabis stores will need to sell only parts of the plant deemed legal in Thailand. Additionally, the new law will make products containing more than 0.2% THC illegal under the Narcotics Code.

The Impact on Cannabis Shops

The proposed legislation will not immediately shut down existing cannabis shops and dispensaries. Instead, these outlets will be regulated within the new law’s framework, focusing solely on medical use. This move aims to clearly distinguish between medical and recreational use without targeting individual users with legal action.

However, the bill’s enforcement, especially in banning recreational use, poses considerable challenges. There are questions about the feasibility of this undertaking, given the numerous steps and processes the bill will need to go through before it can pass into law.

Concerns and Criticisms

The proposed legislation has drawn criticism from some stakeholders, and it remains unclear whether it will be subject to further amendments. Former Health Minister Anutin Charnvirakul’s influence may potentially prevent a tightening of current cannabis regulations, although the impact of his opinions on the final decision remains uncertain.

The International Context

Overseas, there have been significant drug seizures connected with Thailand, highlighting the issue of illegal cannabis exports from the country. For instance, over €1.1 million worth of cannabis was recently seized in Ireland, with some of it found in parcels sent from Thailand.

The new cannabis legislation in Thailand reflects a broader international trend towards stricter regulation of cannabis, especially concerning its medical use. While the bill is still under review and its final form remains uncertain, its progress will be watched closely both domestically and internationally.
